Terms of Service

Last updated 6 October 2026

The short version: you give us accurate details and pay for what you order; we deliver it with reasonable care and skill. Domains, hosting and custom projects each have a few specific rules, set out below. Our Refund Policy and Privacy Policy are part of these terms.

1. About these terms These Terms of Service apply to your use of the NexWave Solutions website and client portal and to everything you buy from us, including domain registration, hosting, custom applications and related services (together, the "Services"). By creating an account, placing an order or using the Services, you agree to these terms. If you do so on behalf of a company, you confirm that you have authority to bind that company, and "you" then means the company.

2. Your account You must give accurate and complete details when you sign up, including your company name, and keep them up to date.

You are responsible for keeping your password secure and for everything done through your account. Tell us straight away if you suspect someone else has used it.

You must be 18 or older, or the company you represent must be properly established, to hold an account.

We may refuse, suspend or close an account that breaks these terms or that we reasonably believe is being used for fraud.

3. Orders, prices and payment Prices on the website are shown in the currency displayed. Prices shown in dollars or other currencies are charged in South African rand through our payment provider (PayFast or Paystack) at the exchange rate we publish at checkout. Where we are registered for VAT, VAT is shown on your invoice.

Payment is made through our payment provider (PayFast or Paystack). Your order is accepted once we receive confirmation of payment and send you confirmation.

We may cancel an order, with a full refund, if there is an obvious pricing error, if a service is unavailable, or if we reasonably suspect fraud.

Services are billed for the period stated on your order. Before a period ends we send a renewal invoice; a service continues for the next period once that invoice is paid.

Payment Due Date & Late Fees: Invoices are strictly payable within 7 (seven) days of the invoice date. If an invoice remains unpaid after the due date:

Overdue accounts will incur an administration fee of R250.00 per overdue invoice.

Outstanding balances will accrue interest at the rate of 2% per month (compounded daily) from the due date until the date of full settlement, subject to applicable South African legal limits.

If an invoice stays unpaid after we have reminded you and the 7-day payment window has lapsed, we may immediately suspend or restrict the related service until the balance, accrued interest, and administration fees are paid in full.

4. Domain names We act as a reseller. Domains are registered through our registrar and the relevant domain registry, and their rules (including ICANN and local registry policies) apply to you.

Availability shown on our website is a guide. A registration is only confirmed once the registry accepts it. If a domain turns out to be unavailable, we refund you in full.

You will be the registrant of the domain. You must give accurate contact details; false details can lead to a domain being suspended or cancelled.

You are responsible for choosing a name that does not infringe anyone's trade mark or other rights, and for any dispute about your name.

Keep track of your renewal dates. We may send reminders as a courtesy, but a domain that is not renewed in time can expire and be deleted or become subject to extra recovery fees.

Transfers to or from another registrar follow registry rules, including any lock periods.

5. Hosting Hosting is provided as described on the plan you buy. Resource limits and fair-use rules for the plan apply.

We work to keep services available, but we cannot promise uninterrupted service. Any availability commitment applies only if it is stated in the plan description or in a written agreement. Our status page shows current service health.

You are responsible for your website's content and software, including keeping it updated. Keep your own backups; we cannot guarantee that we can recover data you have lost.

We may carry out maintenance and will try to give notice of planned work that affects you.

6. Custom applications and projects Custom work is agreed in a written quote or project agreement that sets out the scope, price, schedule and payment milestones. If it conflicts with these terms, the written agreement prevails for that project.

Work outside the agreed scope is handled as a change request and priced separately.

Unless the agreement says otherwise, once we have received full payment you own the custom code written specifically for you. We keep our pre-existing tools, libraries and know-how, and third-party and open-source components stay under their own licences.

You agree to give us the information, access and feedback we reasonably need to do the work on time.

7. Acceptable use You must not use the Services to:

break the law or host or distribute illegal content;

send spam, run phishing sites or distribute malware;

infringe copyright, trade marks or other rights;

attack, probe or disrupt other systems or our own, including the client portal;

host content that exploits children or promotes violence or hatred;

use resources in a way that harms other customers.

If you breach this section we may remove content or suspend the Services. For serious or urgent cases (such as malware or an active attack) we may do so without notice.

8. Support Support is available through support tickets in the client portal and by email at info@nexwave.co.za. Response times we mention are targets, not guarantees.

9. Intellectual property The NexWave Solutions website, design, text and branding belong to us or our licensors. You keep ownership of your own content. You give us permission to store, host and process it as needed to provide the Services.

10. Ending the agreement You can stop using a service at any time; refunds are covered by our Refund Policy. We may end or suspend a service if you breach these terms, if you do not pay, or if the law requires. Where reasonable, we give notice first. After a service ends we may delete the related data after a reasonable period, so ask us for any export you need before then.

11. Our responsibility to you We provide the Services with reasonable care and skill. To the extent the law allows, we are not liable for indirect or consequential loss, such as lost profits, lost business or lost data, and our total liability for any claim relating to a Service is limited to the amount you paid us for that Service in the 12 months before the claim arose.

Nothing in these terms limits your rights under the Consumer Protection Act, 2008 or any other law, or any liability that cannot lawfully be limited.

12. Third parties and things outside our control We rely on third parties such as payment processors, registrars, registries and internet providers. We are not responsible for events outside our reasonable control, including their outages and decisions, but we will help you resolve problems that arise from them.

13. Your responsibility You are responsible for your content and for how you use the Services. You will compensate us for losses we suffer because of a third-party claim that your content or your use of the Services breaks the law or someone else's rights.

14. Notices and electronic communication You agree that we may give you notices, invoices and other messages by email and through the client portal, and that these have the same effect as written notices, as the Electronic Communications and Transactions Act, 2002 allows.

15. Changes to these terms We may update these terms from time to time. We will tell account holders about significant changes by email or in the client portal. Changes do not affect a Service period you have already paid for. If you keep using the Services after a change takes effect, you accept the updated terms.

16. Governing law and disputes These terms are governed by the laws of the Republic of South Africa. Please contact us first so we can try to resolve any complaint informally. This does not affect your right to approach the courts or any consumer complaint body.

17. Contact NexWave Solutions, info@nexwave.co.za. You can also open a support ticket in the client portal.
